Introduction to the BTCA WELFARE FOUNDATION

  • The BTCA Welfare Foundation was established in 1988 as a California Non-Profit Public Benefit Corporation to promote the humane interest of the pure bred Bull Terrier. We received our 501(c)3 IRS status as a charity in 1991 which means that any contributor may claim a deduction on their federal income tax.

  • The Foundation promotes the humane interests of the Bull Terrier by providing funds for both individuals and regional Bull Terrier Clubs who find homes for abandoned Bull Terriers and/or reunites these animals with their owners. We also provide funds for medical studies and have an ongoing educational program.

  • As a public service, the Foundation has linked together 31 regional Bull Terrier clubs across the United States and Canada for the purpose of providing assistance in their rescue programs and providing educational materials on the Bull Terrier. Through the efforts of the Foundation's Rescue Committee, over 400 Bull Terriers have been placed in new homes. Without our assistance some of these animals would have undoubtedly been euthanized.

  • We are also pleased with our Medical Research committee which has persuaded 185 Bull Terrier owners, nationwide, to have their pets entered into a medical research program at Tufts University. Drs. Nick Dodman BVMA and Alice Moon Ph.D. have been conducting health studies involving genetics, metallic ion, phenotypic data collection and EEG analysis. They have also provided pharmacological results on several Bull Terriers. These studies were conducted on animals which demonstrated behavior such as tail chasing, rage, peculiar pre-occupations and fears, hyperactivity and sound sensitivity. In the past, these afflicted animals would have been put to sleep. However, it was Dr. Dodman's opinion that these behaviors might be attributed to a single syndrome associated with pathophysiologic changes in the central nervous system.

  • Dr. Moon is a full-time post-doctoral fellow working in the Tuft's behavioral clinic to develop an animal model for human obsessive compulsive disorders. Through her research and her work with Dr. Dodman she has concluded there is an overlapping of similarities between humans and animals relative to these disorders.

  • Unlike a dog club, the Foundation does has no provision for annual dues, therefore, has no fixed annual income. In order to continue with our rescue and medical research programs, we must depend upon donations from caring people.

  • Should you wish to help our Bull Terriers, your tax deductible donation should be made payable to the BTCA Welfare Foundation and forwarded to Laura Wendler, Charitable Giving Committee, 4 Holiday Drive, Shrewsbury, PA 17361.

    ESTATE PLANNING FOR THE WELFARE OF BULL TERRIERS

    Whether you live with Champion Magnificent Marvin of Mindor ROM, or Riptides Rapscallion, he is the joy and bane of your existence. Planning for his future if something should happen to you is a vital concern. The Bull Terrier Club of America Welfare Foundation has prepared this pamphlet to assist you in your estate planning. The pamphlet contains some suggestions for clauses to be contained in your Will. When you have decided on the way you wish to leave your estate, it is important to consult an attorney to help you prepare your Will in accordance with the law of your state. The BTCA Welfare Foundation is a California nonprofit corporation recognized by the Internal Revenue Service as a charity, donations to which are deductible for income tax and estate tax purposes. The purpose of the Welfare Foundation is to promote the humane interests of the purebred Bull Terrier. The work of the Foundation is done by volunteers committed to the purpose of the Foundation.
    YOUR WILL TO HELP
    Bull Terriers have been important to you. You have worked hard for their welfare. While you plan the disposition of your estate, you can make provision for your caring to continue.

    A gift to the BTCA Welfare Foundation contained in your Will could read as follows:

    "I give to the BTCA Welfare Foundation, a charitable corporation, with a mailing address of 1526 Belleau Road, Glendale, California, the sum of $20,000."

    Another form of gift contained in a Will is a residuary gift, one that makes the BTCA Welfare Foundation the recipient of all or a part of your estate after providing specific gifts for others. Such a clause might read as follows:

    "All of the rest, remainder, and residue of my property, I give, devise and bequeath to the BTCA Welfare Foundation, a charitable corporation, with a mailing address of 1526 Belleau Road, Glendale, California."

    Another form of a residuary clause would read as follows:

    "I give, devise, and bequeath one-half of the residue of my estate to the BTCA Welfare Foundation, a charitable corporation with a mailing address of 1526 Belleau Road, Glendale, California, and one-half of the residue to my nephew Herbert Jones."


    SAFEGUARDING YOUR BULL TERRIER
    Planning for your Bull Terrier in the event of your death is an important and difficult part of your estate planning. Care must be taken because of the limitations the law imposes on gifts from your estate. For example:

    Courts will not allow you to leave money outright to Riptides Rapscallion.

    Most states will not allow you to leave money in trust for Rapscallion. A trust arrangement is one in which an individual is put in charge of a fund of money to be used for the benefit of your dog.

    Most states will not honor a conditional gift established to provide money to care for Rapscallion. A conditional gift is a gift that requires the recipient to perform the service of caring for your dog.


    WHAT CAN BE DONE?

    First of all -- PLAN!

    Without a plan Rapscallion is treated like any other piece of property in your estate. If you have no Will, he will go to a relative like your mother, Irma, or your brother, Max. While you may love Irma and Max, they may not be the individuals that can or should care for Rapscallion. And remember - part of your plan to provide a home for Rapscallion is to provide the means to care for him. Next, since the courts will not protect Rapscallion, you must do so. Your best options are to work with the BTCA Welfare Foundation, a trusted friend, or, better yet, both. The BTCA Welfare Foundation is committed to finding a loving home for all placeable Bull Terriers. You could leave Rapscallion to a friend and use the Welfare Foundation as a back-up in case your friend's circumstances change. A Will clause to do this might read as follows.

    "I give my dog Rapscallion and/or any other bull Terrier I own at the time of my death, together with his bed, toys, sweaters, and equipment to my friend, Ida James. In the event Ida James does not survive me, or is unable to accept the bull Terrier, I leave him to the BTCA Welfare Foundation, a charitable corporation with a mailing address of 1526 Belleau Road, Glendale, California. I leave to the BTCA Welfare Foundation the sum of $15,000 and request the Foundation to provide such amount as is necessary for Rapscallion's health care and maintenance; any additional amount should be used for the general purposes of the BTCA Welfare Foundation."

    In the alternative, you could leave Rapscallion to the foundation. Such a Will clause could read as follows:

    "I leave my dog, Rapscallion and/or any other Bull Terrier I own at the time of my death, together with the sum of $20,000, to the BTCA Welfare Foundation, a charitable corporation with a mailing address of 1526 Belleau Road, Glendale, California. I request the BTCA Welfare Foundation to find a loving home for Rapscallion and to provide for him during his life. My friend, Ida James has expressed a willingness to care for him. If she is still able to provide such a home, I request the Foundation to place Rapscallion with her."

    If you do not have a suitable home for Rapscallion, you may wish to work with the BTCA Welfare Foundation during your life to find a suitable placement at the time of your death.


    GIFTS OUTSIDE PROBATE

    Many assets that you own will not be part of your probate estate. For example, life insurance policies, Individual Retirement Accounts (IRA) and other pension type accounts will go to the beneficiary named in the contract. Designating the BTCA Welfare Foundation as the beneficiary on insurance policies and retirement accounts is an excellent way to continue your interest and concern for your Bull Terriers after your death.
    FURTHER CONSIDERATIONS
    While you should consult with an attorney to prepare your Will, your estate plan is yours. Attorneys do not always see the importance of providing special treatment for special animals. Your Will is your plan. Insist that the Bull Terrier that has been important to you during your life is provided for at your death.
